Core Group raises concerns at UNHRC on Shavendra’s appointment
The Core Group on Sri Lanka raised concerns at the UN Human Rights Council (UNHRC) during its ongoing session on the appointment of Lieutenant General Shavendra Silva as the Army Commander.
In a statement made on behalf of Canada, Germany North Macedonia, Montenegro, and the United Kingdom as members of the Human Rights Council core group on Sri Lanka, the UK’s International Ambassador for Human Rights, Rita French outlined that the UK remains steadfast in its commitment to help Sri Lanka deliver peace, reconciliation and prosperity for all communities.
“It is four years since Sri Lanka took ownership of delivering wide ranging reforms to advance reconciliation, accountability and human rights through co-sponsorship of Council resolution 30/1. Sri Lanka repeated these commitments, most recently through HRC resolution 40/1, six months ago,” she said.
She said that the Core Group believes that the pledges made by Sri Lanka to its people are the essential ingredients for national healing, stability and prosperity.
“The Core Group remains steadfast in its commitment to supporting Sri Lanka’s future through the implementation of the resolution. Continued support for the process from the Government and people of Sri Lanka will be critical for these measures to succeed,” she said.
Rita French said that there have been important developments since 2015 which demonstrate good intentions on the part of the Government and reflect the work of many committed individuals.
“Some key domestic institutions have been established. However, the pace of progress has remained slow in many areas, with bureaucratic constraints hampering delivery,” she added.
The Core Group noted that in the most recent resolution, the Council encouraged Sri Lanka to set a clear timeline for action, through a national implementation strategy.
“We hope that Sri Lanka will put this in place as a matter of priority. Madame High Commissioner, we share the concern expressed in your statement of 19 August that the appointment of General Silva as Army Commander severely compromises Sri Lanka’s commitment to promote justice and accountability and undermines reconciliation efforts. The core group believes that it is vital for peace and prosperity that Sri Lanka builds confidence in its commitment to protecting political space and human rights,” the Core Group said.
The Core Group noted that the Council has been seized with the situation in Sri Lanka over many years and has made an essential contribution towards addressing serious violations of the past.
However the Core Group noted that this work remains incomplete, and requires our ongoing attention.
“It is vital that this Council and the international community continues to give the necessary attention and support to Sri Lanka as it continues on the path towards enduring peace and reconciliation,” the Core Group said
Sujeewa says purported letter from Akila vague and unprofessional
United National Party (UNP) Parliamentarian and Minister of Science and Technology, Sujeewa Senasinghe, has written to UNP General Secretary Akila Viraj Kariyawasam over a show cause letter he had received.
Senasinghe says he received the letter by fax but does not believe it was sent by the UNP General Secretary as it is vague and unprofessional.
The Minister called on the UNP General Secretary to conduct an inquiry into the bogus letter which tarnishes the image of the UNP General Secretary and Legal Secretary of the UNP.
He also said that if the letter was indeed sent by the UNP General Secretary then it is the duty of the UNP General Secretary or Legal Secretary to mention the provisions in the UNP constitution under which action is being taken.
The Minister also said that the UNP General Secretary or Legal Secretary must also submit copies of the purported complaints against him.
A letter had been sent to Senasinghe by the UNP General Secretary saying there were complaints against him, accusing him of making public comments against the party and the party leadership.
Deputy Minister Palitha Thewarapperuma jailed
Deputy Minister Palitha Thewarapperuma was today ordered to be remanded together with four others for breaching a court order.
The Mathugama Magistrate ordered that the Deputy Minister be remanded till September 16.
He has been accused of burying a body at an unauthorized land, disregarding a court
Judge reinstates block on Trump’s asylum ban
A federal judge in California on Monday reinstated a ban on the implementation of a Trump administration policy that would restrict migrants’ ability to apply for asylum at the southern border.
U.S. District Judge Jon Tigar had issued a nationwide injunction in July blocking the rule, which would make most asylum-seekers who pass through another country before reaching the U.S. ineligible for asylum, with exceptions for victims of trafficking and migrants who have been denied asylum in the countries they traveled through.
The rule would primarily effect Central American migrants crossing through Mexico.
The 9th U.S. Circuit Court of Appeals upheld Tigar’s initial ruling but narrowed the injunction to only border states within its jurisdiction — California and Arizona — before sending the question back to Tigar.
Tigar said Monday that the injunction should apply nationwide because the asylum rule represents a case where “such breadth is necessary to remedy a plaintiff’s harm.”
The Trump administration last month asked the Supreme Court to lift Tigar’s injunction.
“The injunction now in effect is deeply flawed and should be stayed pending appeal and pending any further proceedings in this Court,” Solicitor General Noel Francisco said in a filing.
The White House blasted the judge’s decision in a statement.
“Immigration and border security policy cannot be run by any single district court judge who decides to issue a nationwide injunction,” the White House said. “This ruling is a gift to human smugglers and traffickers and undermines the rule of law. We previously asked the Supreme Court to set aside the district court’s injunction in its entirety, our request remains pending with the Court, and we look forward to it acting on our request.”
Acting Customs and Border Protection Commissioner Mark Morgan said Monday that he was “frustrated” by the ruling and described it as a result of “unprecedented judicial activism.”
“It’s very very frustrating but we’re going to keep going. We’ll continue to work within the current legal framework address this,” Morgan told reporters at the White House.
