US woman sentenced for enslaving Sri Lankan woman

A North Jersey woman in the US was sentenced to prison for forcing a Sri Lankan woman to work as a nanny and housekeeper in her homes for almost a decade without pay, US Media reported.
A federal judge in Camden on Tuesday sentenced the woman to 5 years and 10 months in federal prison.
Alia Imad Faleh Al Hunaity, a.k.a. Alia Al Qaternah, 44, a naturalized U.S. citizen from Jordan, had brought the victim, a Sri Lankan national, to the United States on a temporary visa in 2009 to perform domestic work.
Hunaity caused the victim to overstay her visa and remain in the United States illegally for more than nine years, federal prosecutors have said.
Hunaity, a cancer research scientist, was convicted by a federal jury in Camden in May on charges of forced labor, alien harboring for financial gain, and marriage fraud.
She had forced the victim to cook and clean her homes in Woodland Park and Secaucus and to care for her three children, all without pay, prosecutors have said.
In 2018, Hunaity forced the woman to marry her so that the woman could obtain legal residence and continue to work for her, authorities have said.
This case “began with lies from the defendant to the victim about coming to the United States” for a better life, U.S. District Judge Robert Kugler said Tuesday.
Instead, Hunaity “never paid the victim a penny,” took $4,000 from the woman, and told her not to speak to other children’s parents so they wouldn’t know she was in the U.S. illegally, the judge said.
Hunaity also “forced the victim into a sham marriage” with Hunaity that brought the victim shame, Kugler said

US court clears way for fresh case on Gotabaya over Lasantha’s killing

A US court has cleared the way for slain journalist Lasantha Wickrematunge’s daughter Ahimsa Wickrematunge to file a fresh case against President Gotabaya Rajapaksa when he is no longer President and is not entitled to immunity.
The Ninth Circuit Court of Appeals granted Ahimsa Wickrematunge’s request to vacate a lower court’s ruling that Gotabaya Rajapaksa is entitled to common law foreign official immunity for acts committed while he was Secretary of Defense of Sri Lanka.
Ahimsa’s lawsuit, filed last April, sought to hold Rajapaksa – now the president of Sri Lanka – responsible for his alleged involvement in the assassination of her father, famed journalist Lasantha Wickrematunge, and in the widespread and systematic targeting of journalists perceived to critical of the government.
Ahimsa is represented by the Center for Justice and Accountability (CJA) and Debevoise & Plimpton LLP.
The Ninth Circuit Court of Appeals also granted Ahimsa’s request to dismiss her case without prejudice, as Rajapaksa’s accession to the presidency of Sri Lanka last November gave him immunity from suits in US courts for so long as he remains president. The Ninth Circuit’s decision clears the way for future litigation against Rajapaksa once he no longer enjoys immunity as a head of state.
“This ruling is a victory, and a message to Gotabaya Rajapaksa: His maneuvers to escape justice  for his role in my father’s assassination continue to fail. He will not enjoy immunity forever, and his presidency can only delay, not prevent, accountability. Those of us who lost everything to his barbarism and bloodshed will never give up our fight for justice,” says Ahimsa Wickrematunge.
“Lasantha’s killing was neither authorized nor ratified by the Sri Lankan government, and the violent targeting of journalists should never be considered legitimate acts of state,” said CJA Legal Director Carmen Cheung. “We are pleased that Ahimsa will have the opportunity to bring her case again.”

US Congress to be informed of Sri Lanka’s objections to travel ban on Lt. Gen. Shavendra

The United States (US) Congress is to be informed of Sri Lanka’s objections to the travel restrictions imposed by the United States on Lt. Gen. Shavendra Silva, Commander of the Army and Acting Chief of Defence Staff and his immediate family.
Foreign Minister Dinesh Gunawardena met today (17 February 2020) the visiting US Congressional delegation, comprising Ami Bera, MD, Chairman, House Foreign Affairs Subcommittee on Asia, the Pacific, and Non-Proliferation and Representative Mr. George E.B. Holding, Member of the House Ways and Means Committee, Budget Committee and Ethics Committee and two members of the Congressional Committee Staff.
Minister Gunawardena welcomed the US Congress Representatives and highlighted the need to move forward in new areas of cooperation that would boost Sri Lanka’s economy. He said the visit took place at a significant time to Sri Lanka and briefed the delegation on the initiatives taken to broadbase Sri Lanka’s relationship with the US in ICT, Science, Technology and innovation and agriculture sectors through sector-focused dialogues, with representatives of the specific sectors from both sides.
The two Representatives of the Congress articulated the strong desire of the Government of the United States of America to advance the multifaceted relationship with Sri Lanka as an important strategic partner of the USA.
Noting the importance of enhancing the economic cooperation between the two countries, Representative Bera and Representative Holding, expressed the willingness of the US side to increase Foreign Direct Investment in both countries.Recognising Sri Lanka’s strategic geographic position in the world map, they also emphasised the importance of enhancing maritime cooperation with the island.
The Minister availed of the opportunity of meeting the Congressional delegation to reiterate strong objections of the Government of Sri Lanka on the recent imposition of travel restrictions on Lt. Gen. Shavendra Silva and his immediate family and asked that the United States review its decision.
He emphasised the importance of continuing defence cooperation, and observed the need to overcome such hindrances without causing embarrassment to either party.
The delegation took note of the concerns and informed that they would convey these sentiments to the US Congress.
The Congress Delegation was joined at the discussions by US Ambassador Alaina Teplitz and Embassy officials. Foreign Secretary Ravinatha Aryasinha and Director General/ North America, Dharshana M. Perera, and officials of the Ministry, were associated with the Minister during the talks.
The delegation had calls on President Gotabaya Rajapaksa, Prime Minister Mahinda Rajapaksa, Speaker Karu Jayasuriya and Senior Advisor to the Prime Minister on Foreign Affairs Prof. G.L. Peiris during their stay in Sri Lanka.
The delegation was hosted to lunch by Foreign Secretary Ravinatha Aryasinha prior to their departure today, which was attended by leading Sri Lankan business personalities and Heads of economic-related government institutions

Sri Lanka requests the US to review decision on Shavendra

Sri Lanka has requested the United States (US) to review its decision to ban Lieutenant General Shavendra Silva, current Commander of the Sri Lanka Army and Acting Chief of Defense Staff.
The US Department of State designated Lieutenant General Shavendra Silva and his immediate family members. The public designation makes them ineligible for entry into the United States.
The Government of Sri Lanka said that it takes strong objection to the imposition of travel restrictions on Lt. Gen. Silva and his immediate family members by the Government of the United States, based on independently unverified information.
The Government reiterates that Lt. Gen. Shavendra Silva was appointed as the Commander of the Army by the then Head of State, taking into account his seniority and that there were no substantiated or proven allegations of human rights violations against him.
His elevation as the Acting Chief of Defence Staff by the current Head of State President Gotabaya Rajapaksa, was on account of his being the senior most serving military officer.
While the timing of the imposition of this travel restriction 6 months after Lt. Gen. Silva’s appointment as Army Commander is concerning, the Sri Lankan Government says it is disappointing that a foreign Government should question the prerogative of the democratically elected President to call upon persons with proven expertise to hold key positions on national security related matters.
The Government of Sri Lanka requests the United States to verify the authenticity of the sources of information and to review its decision.

US Congressmen meet PM to discuss relations with Sri Lanka

Visiting US Congressmen Ami Bera and George Holding met Prime Minister Mahinda Rajapaksa in Colombo this morning (Feb. 15) and discussed ways of strengthening relations in a number of sectors.
This is the first meeting between US officials and Sri Lanka after the US designated Lieutenant General Shavendra Silva, current Commander of the Sri Lanka Army and Acting Chief of Defense Staff, as required under Section 7031(c) of the Department of State, Foreign Operations, and Related Programs Appropriations Act, due to credible information of his involvement, through command responsibility, in gross violations of human rights, namely extrajudicial killings.
“I think this is the most vibrant region and has a lot of potential,” Congressman Bera said during his meeting with the Prime Minister. “We see opportunity to forge a strong relationship between the United States and Sri Lanka.”
Congressman Bera represents California’s 7th Congressional District in the US House of Representatives and is currently a member of the House Foreign Affairs Committee where he serves as Chair of the Subcommittee on Asia, the Pacific, and Nonproliferation.
The Prime Minister stated that one of the key priorities for the country at this time is economic development and encouraged more US investments in Sri Lanka.
Congressman Holding agreed that there is real opportunity to strengthen economic relations, pointing out that there is foreign direct investments from Sri Lanka in his own state.
Representing North Carolina’s 2nd Congressional District, Congressman Holding serves on the House Ways and Means Committee, Budget Committee and Ethics Committee.
With his focus on trade and commerce, Congressman Holding said strong economic relations can often play a significant role in enhancing overall relations between two countries.
Rajapaksa said that he agreed that there is a lot of potential for investments from the United States to Sri Lanka as well as from Sri Lanka to the United States. Other areas of cooperation were also discussed, including in the sectors of counter terrorism, tourism and energy.
US Ambassador in Sri Lanka Alaina Teplitz who also attended the meeting, talked about Sri Lanka’s larger role in the region.
“We support a strong, sovereign Sri Lanka,” Ambassador Teplitz said. “We’re thinking about Sri Lanka’s role in the broader region.

Judge reinstates block on Trump’s asylum ban

A federal judge in California on Monday reinstated a ban on the implementation of a Trump administration policy that would restrict migrants’ ability to apply for asylum at the southern border.

U.S. District Judge Jon Tigar had issued a nationwide injunction in July blocking the rule, which would make most asylum-seekers who pass through another country before reaching the U.S. ineligible for asylum, with exceptions for victims of trafficking and migrants who have been denied asylum in the countries they traveled through.

The rule would primarily effect Central American migrants crossing through Mexico.

The 9th U.S. Circuit Court of Appeals upheld Tigar’s initial ruling but narrowed the injunction to only border states within its jurisdiction — California and Arizona — before sending the question back to Tigar.

Tigar said Monday that the injunction should apply nationwide because the asylum rule represents a case where “such breadth is necessary to remedy a plaintiff’s harm.”

The Trump administration last month asked the Supreme Court to lift Tigar’s injunction.

“The injunction now in effect is deeply flawed and should be stayed pending appeal and pending any further proceedings in this Court,” Solicitor General Noel Francisco said in a filing.

The White House blasted the judge’s decision in a statement.

“Immigration and border security policy cannot be run by any single district court judge who decides to issue a nationwide injunction,” the White House said. “This ruling is a gift to human smugglers and traffickers and undermines the rule of law. We previously asked the Supreme Court to set aside the district court’s injunction in its entirety, our request remains pending with the Court, and we look forward to it acting on our request.”

Acting Customs and Border Protection Commissioner Mark Morgan said Monday that he was “frustrated” by the ruling and described it as a result of “unprecedented judicial activism.”

“It’s very very frustrating but we’re going to keep going. We’ll continue to work within the current legal framework address this,” Morgan told reporters at the White House.

Speaker Karu Jayasuriya and Multiparty Delegation Visit Washington D.C.

Speaker of the Parliament of Sri Lanka Karu Jayasuriya led a multiparty parliamentary delegation to the U.S. capital from September 25-29.

The delegation included Minister of Transport and Civil Aviation Nimal Siripala de Silva, Minister of Women and Child Affairs Chandrani Bandara, State Minister of Irrigation & Water Resources Management Palitha Range Bandara, Members of Parliament Vijitha Herath, Kumara Welgama and M.A. Sumanthiran, and Deputy Secretary General of Parliament Neil Iddawala.

During the visit, Speaker Jayasuriya and the delegation met with the Speaker of the U.S. House of Representatives Paul Ryan at the U.S. Capitol. They also had fruitful discussions with several members of congress from both the republican and democratic parties, including Senator Chris Van Hollen, who was the former democratic co-chair of the House Congressional Caucus on Sri Lanka until his election to the Senate at the beginning of this year. Senator Van Hollen is a longtime friend of Sri Lanka. The delegation also met the present co-chairs of the Sri Lanka Caucus, Representatives Robert Aderholt and Dina Titus; Chairman of the House Foreign Affairs Subcommittee on Asia and the Pacific Rep. Ted Yoho; and Ranking Member of the subcommittee Rep. Brad Sherman.

Following up on the congressional visit to Sri Lanka by the House Democracy Partnership (HDP) of the U.S. House of Representatives in February, the delegation met with its Chairman Rep. Peter Roskam, Ranking Member Rep. David Price, and HDP members Rep. Gerald Connolly and Rep. Gwen Moore. During the previous visit of Speaker Jayasuriya to Washington D.C. a year ago the Sri Lanka Parliament and the HDP signed a collaboration agreement to strengthen partnership between the two legislatures.

The delegation briefed the members of congress on developments in Sri Lanka, particularly in relation to constitutional reforms. The Parliament of Sri Lanka is marking 70 years of parliamentary democracy this year. They emphasized on the value of strengthening cooperation between the Sri Lanka Parliament and the U.S. Congress to underpin the expanding bilateral partnership. The Speaker invited the members of congress to visit Sri Lanka and see first hand the developments on the ground.

The members of congress commended the progress made by the Sri Lankan government since 2015 in advancing political and economic reforms, taking concrete measures to advance human rights, good governance and reconciliation. They acknowledged the importance of enhancing and expanding the U.S. – Sri Lanka partnership in diverse spheres, including at the legislative level, and assured the support of the U.S. Congress towards this end.

The visit to Washington D.C. took place as part of the USAID-sponsored programme – Strengthening Democratic Governance and Accountability Project in Sri Lanka (SDGAP). SDGAP is a three-year programme with the Sri Lankan Parliament to strengthen public accountability systems; improve planning, communication, policy reform, and implementation; and increase the participation of women in politics. The visit to the U.S. Congress allowed the parliamentary delegation to experience firsthand the workings of the U.S. system.

මෙම ද්විපාර්ශ්වික පුහුණු සැසිය පවත්වන ලද්දේ රාජපක්ෂ පාලනය යටතේ දෙරට අතර අත්සන් තබන ලද මතභේදාත්මක මිලිටරි ප්‍රවර්ධන ගිවිසුම තවත් වසර දහයක කාලයකට දීර්ඝ කිරීමේ සැලසුම් දෙරටෙහි ආණ්ඩු විසින් අනාවරණය කිරීමත් සමග ය. ශ්‍රී ලංකාව සහ එක්සත් ජනපදය අතර පවරාගැනීමේ සහ අන්‍යෝන්‍ය සේවා සැපයුම් ගිවිසුමක් (Acquisition and Cross Servicing Agreement – ACSA) වසර දහයක කාලයක් සඳහා වලංගුවන පරිදි 2007 මාර්තු මාසයේ දී අත්සන් තැබුණු අතර එක්සත් ජනපදයේ ආරක්ෂක දෙපාර්තමේන්තු (US Department of Defence – DoD) නිල වෙබ් අඩවියට අනුව රටවල් 76ක් සමග දැනට අත්සන් කර ඇති අදාළ ගිවිසුම සැලසුම් කොට ඇත්තේ ඇමරිකානු ඉදිරි හමුදා විහිදුවීම් හා ආරක්‍ෂක අභිලාෂයන්ට ඵලදායක වනු පිණිස ය.

සැප්තැම්බර් පළමුවැනි දා කොළඹ දී මුළුදුන් ඉන්දියන් සාගර සමුළුව අමතමින් එක්සත් ජනපදයේ දකුණු හා මධ්‍යම ආසියානු කටයුතු පිළිබද වැඩබලන රාජ්‍ය ලේකම්වරිය කියා සිටියේ පළමු වතාවට සිදුවන එක්සත් ජනපද – ශ්‍රී ලංකා ඒකාබද්ධ නාවුක අභ්‍යාස (CARAT) එළඹෙන ඔක්තෝබර් මාසයේ ත්‍රිකුණාමලයේ දී ඇරැඹෙන බව ය.

“හවුල් ධාරිතා වර්ධනයන් හා අභ්‍යාස ඔස්සේ, සංකීර්ණතා ගහණ මෙම කලාපයේ ආරක්ෂක බර අපට බෙදාගත හැකිවනු ඇතැ” යි වෙල්ස් එහි දී කියා සිටියා ය.

CARAT යනු බංගලාදේශය, බෲනායි, කාම්බෝජය, ඉන්දුනීසියාව, මැලේසියාව, සිංගප්පූරුව, පිලිපීනය, ශ්‍රී ලංකාව, තායිලන්තය සහ නැගෙනහිර ටිමෝරය යන රටවල් දහයක් සමග එක්සත් ජනපදය විසින් වෙන් වෙන්ව වාර්ෂිකව පවත්වන ද්වී පාර්ශ්වික නාවික අභ්‍යාස වැඩසටහන් මාලාවකි. මෙකී වැඩසටහන් මූලික වශයෙන් සැළසුම් කර ඇත්තේ එක්සත් ජනපද නාවික හමුදාවේ සාමුද්‍රික ශක්‍යතා හා ක්‍රියාන්විත සංසක්තතාවන් වැඩිදියුණු කිරීම අරමුණු කොටගෙන ය.

Farewell for Ambassador Prasad Kariyawasam in Washington D.C

“Though I wind up as Ambassador to the USA, I want to say that I will forever remain an Ambassador for ‘U.S.-Sri Lanka relations.’ I believe there is so much that our two countries, though geographically distant, can achieve for mutual benefit”, Ambassador Prasad Kariyawasam said addressing a distinguished gathering at a farewell reception hosted by the U.S. State Department this morning.

The State Department hosted the reception for a select group of well wishers of Sri Lanka, including U.S. government representatives, Washington-based foreign diplomats, and representatives from business establishments, civil society and non-governmental organizations, in honour of the Sri Lankan Ambassador who leaves the U.S. capital later this week to take up a new assignment as the Secretary of the Ministry of Foreign Affairs.

Welcoming the Ambassador, Assistant Chief of Protocol Gladys Boluda recalled the Ambassador’s close association with the State Department in the past three years and remarked that the turnout at the reception was a statement to his accessibility to his peers and interlocutors at all times. Echoing a long-held view in the State Department that governments send their best to serve in Washington D.C., she said this was certainly justified in the case of Ambassador Kariyawasam, whose next assignment in Colombo further strengthened this claim.

Under Secretary of State for Political Affairs, Ambassador Thomas Shannon observed that Ambassador Kariyawasam was witness to two transitions in administration during his tenure – one in Sri Lanka in 2015, the other in the U.S. in 2017 – and was able to navigate both skillfully for the benefit of both countries. He hailed the upward trajectory in bilateral relations and recalled the inaugural U.S. – Sri Lanka Partnership Dialogue in 2016 in which he and the Ambassador played a leading role to set up a structured framework for bilateral cooperation. Under Secretary Shannon pointed to Sri Lanka’s significance as a key player in the U.S. Indian Ocean policy and alluded to the immense potential for expanding the bilateral partnership.

Ambassador Kariyawasam recalled the historic government transition in Sri Lanka in 2015 which engendered a path-breaking revival in Sri Lanka’s bilateral relations with the United States, and the landmark achievements in the partnership since, including, among others, Sri Lanka’s selection for development programs by the Millennium Challenge Corporation, the many high level bilateral visits and the renewal of military cooperation. This trend continues in spirit and in substance under the current U.S. administration, he said, observing that, like all relationships, constant care and nurturing would be required to sustain the partnership and guide it to greater heights.
